1. Agreement to Terms
By accessing or using any WhiteOut service, including the WhiteOut VPN application, WhiteOut Security browser extension, WhiteOut mobile application, or the website at whiteoutvpn.com (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Service Description
WhiteOut provides:
- WhiteOut Security: A browser extension for Chrome, Firefox, Brave, and Edge that provides phishing detection, malware blocking, privacy protection, cryptocurrency transaction analysis, and other security features using locally processed threat intelligence.
- WhiteOut VPN: A virtual private network service available in three tiers (Standard, Fortress, and Ghost) that encrypts your internet traffic and routes it through our servers.
- WhiteOut Mobile: A mobile application for Android and iOS that combines VPN and security features with on-device DNS filtering and a sandboxed DApp browser.
3. Eligibility
You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
4. Account Registration
To access paid features, you must create an account using one of our supported OAuth providers (Google, Discord, or Telegram). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.
You may not:
- Create accounts using automated methods or bots
- Share your account credentials with others
- Transfer your account to another person
- Create multiple accounts to abuse free trials or promotions
5. Subscription and Payment
5.1 Pricing
WhiteOut offers paid subscription tiers. Current pricing is displayed on our website and within the applications. All prices are in US dollars unless otherwise stated. Prices may change, but changes will not affect active subscription periods.
5.2 Billing
Subscriptions are billed on a recurring basis (monthly) depending on the plan you select. We support two payment paths and you may use either one.
Card payments are processed by Stripe. Card-based subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
Crypto payments for the VPN tiers are processed by SafeConnect Router, an on-chain smart contract. Crypto subscriptions are paid one period at a time and do not auto-renew. Before each period ends, your account dashboard will prompt you to renew with another on-chain payment if you want to continue.
5.3 Cancellation
You may cancel a card subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. You will continue to have access to paid features until the end of the period you have already paid for. Crypto subscriptions do not auto-renew, so there is nothing to cancel.
5.4 Refunds
We offer a 30-day money-back guarantee on new card-based subscriptions. If you are not satisfied with the Service, contact [email protected] within 30 days of your initial purchase for a full refund. Refunds after the 30-day period are at our discretion. Renewal charges are not eligible for the 30-day guarantee but may be refunded if requested before the renewal period has substantially elapsed.
On-chain crypto payments are non-refundable. The SafeConnect Router executes payments as immutable on-chain transactions and we cannot reverse them. If you have a billing dispute related to a crypto payment, contact [email protected] and we will work with you in good faith.
5.5 Failed Payments
If a card payment fails, we will attempt to charge your payment method again over the following days. If payment cannot be collected, your account will be downgraded to an unpaid state. You will retain access to your account but paid features will be disabled until payment is resolved. For crypto subscriptions, if you do not complete a renewal payment before the period ends, paid features will be disabled until you complete a new on-chain payment.
6. Acceptable Use
You agree to use the Service in compliance with all applicable laws and regulations. You may use the Service for lawful purposes, including protecting your privacy, securing your internet connection, accessing content, and protecting yourself from online threats.
7. Prohibited Activities
You may not use the Service to:
- Engage in any activity that violates applicable local, state, national, or international law
- Distribute, store, or transmit child sexual abuse material
- Conduct network attacks, including denial of service attacks, port scanning, or unauthorized access to systems
- Send spam or unsolicited bulk messages
- Distribute malware, ransomware, or other harmful software
- Infringe on the intellectual property rights of others
- Harass, threaten, stalk, or abuse other individuals
- Engage in fraud, phishing, or identity theft
- Resell, sublicense, or redistribute the Service without our written permission
- Attempt to circumvent usage limits, access controls, or security measures of the Service
- Interfere with or disrupt the integrity or performance of the Service or its infrastructure
We reserve the right to suspend or terminate accounts that engage in prohibited activities. In cases involving illegal activity, we may cooperate with law enforcement to the extent required by law, but consistent with our Privacy Policy and our strict no-logging practices, we typically have no user activity data to provide.
8. Intellectual Property
The Service, including all software, design, text, graphics, and trademarks, is owned by WhiteOut and protected by intellectual property laws. "WhiteOut," "WhiteOut VPN," and "WhiteOut Security" are trademarks of WhiteOut. You may not use our trademarks without prior written permission.
The WhiteOut Security browser extension incorporates threat intelligence data from multiple sources. Attributions and licenses for these data sources are available upon request.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, error-free, or completely secure
- The VPN will protect against all possible threats or surveillance methods
- The security extension will detect every phishing site, malware sample, or privacy threat
- The threat intelligence data will be complete or free from false positives
Security is a layered practice. WhiteOut is one layer of your security posture, not a guarantee of absolute protection.
10. Limitation of Liability
To the maximum extent permitted by applicable law, WhiteOut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages resulting from your use of or inability to use the Service.
Our total aggregate liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify and hold harmless WhiteOut, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
12. Service Modifications
We may modify, update, or discontinue features of the Service at any time. For material changes that reduce the functionality of a paid tier, we will provide at least 30 days notice. If a paid feature you rely on is permanently removed, you may request a prorated refund for the remaining subscription period.
13. Termination
We may suspend or terminate your account if you violate these Terms or engage in prohibited activities. We will make reasonable efforts to notify you before termination, except in cases of severe or illegal violations where immediate action is necessary. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 8, 9, 10, 11, and 14) will survive.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of the Canton of Geneva, Switzerland, unless otherwise required by mandatory consumer protection laws in your jurisdiction.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email and/or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the new Terms take effect.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and WhiteOut regarding the Service and supersede any prior agreements.
